Under Regulation (EU) 2025/40 the EU Declaration of Conformity is a short document in which the manufacturer states that the packaging meets the applicable requirements. It is only meaningful because of what sits behind it: the technical documentation required by Annex VII, which must demonstrate that the packaging actually meets those requirements.
A Declaration signed without that evidence base is an exposure, not a safeguard. The technical documentation must be kept available for market surveillance authorities, and it is what they will ask to see.
What we prepare
- Scope definition. The packaging configuration, its components, the product it packages, and the markets it is placed on.
- Requirement and evidence matrix. Every sustainability, labelling and information requirement relevant to the packaging, mapped to the specific evidence that supports it and the date it applies.
- Assembled evidence set. Specifications, bills of materials, supplier declarations, test reports and material data, organised so a third party can follow them.
- Non-conformity risk assessment. Where the evidence is weak, absent or contradicted, stated plainly rather than papered over.
- Documentation index. A controlled index with version and date, so the file can be maintained rather than rebuilt each time the packaging changes.
- Draft EU Declaration of Conformity. Prepared against Annex VIII for the manufacturer to review, approve and sign.
What remains yours
We prepare and structure documentation. The manufacturer carries out the conformity assessment, takes responsibility for the accuracy of the underlying data, and draws up and signs the Declaration. We do not sign it, and we cannot make packaging conform that does not conform.
Not included
- Laboratory testing — we specify what is needed and can identify suitable labs
- EPR registration, national reporting and packaging waste fees
- Legal advice or representation before market surveillance authorities
- Redesign of packaging (we can flag where redesign is the cheaper route)

What happens if the documentation isn't there
The packaging can be restricted
Packaging without valid technical documentation is treated as non-compliant. Market surveillance authorities can require corrective action, restrict sale, or withdraw it from the market.
Penalties apply per Member State
Each Member State sets its own penalties for non-compliance, and they apply where the packaging is placed on the market — not where your business sits.
Buyers block you first
Retailers, distributors and importers increasingly ask for the Declaration and supporting evidence before onboarding. No file usually means no listing.
Late evidence costs more
Supplier declarations and lab testing have long lead times. Discovering a gap close to a deadline forces rushed testing or packaging redesign.
