PPWR requirements in 2026: what actually applies
'Everything changes on 12 August 2026' is the wrong summary. The Regulation applies from that date, but its technical requirements are staged — and several depend on delegated acts that set the detail.

Regulation (EU) 2025/40 replaces the Packaging and Packaging Waste Directive and generally applies from 12 August 2026. From that point packaging placed on the EU market falls under the PPWR framework, including the obligation to hold technical documentation and to draw up an EU Declaration of Conformity for the requirements that apply to it.
What differs is which requirements apply on that date. Treating 2030 obligations as 2026 obligations wastes money; treating 2026 obligations as distant creates real exposure.
Phased timeline
12 August 2026
- Regulation (EU) 2025/40 generally applies and Directive 94/62/EC is repealed.
- Restriction on PFAS in food-contact packaging above the specified thresholds.
- Packaging placed on the market must meet the sustainability and information requirements applicable at that time; technical documentation and an EU Declaration of Conformity must exist for it.
Dependent on delegated and implementing acts
- Design-for-recycling criteria and recyclability performance grades under Article 6.
- Methodologies for recycled content calculation and verification.
- Harmonised labelling formats and symbols.
2028 onwards
- Harmonised material-composition labelling on packaging, and matching sorting labels on waste receptacles.
- Further labelling obligations, including for reusable packaging and deposit systems, on the dates set in the Regulation.
2030 onwards
- Minimum recycled content targets for plastic packaging.
- Recyclability performance thresholds tighten; packaging that does not meet the grade cannot be placed on the market.
- Packaging minimisation, reuse targets and format restrictions phase in on their respective dates.
What to do in practice now
- Define each packaging configuration you place on the EU market.
- Establish your regulatory role for each one.
- Separate the requirements into "applies now", "applies once the delegated act lands" and "applies later" — and give each a named owner and date.
- Chase supplier evidence early. PFAS and recycled-content evidence in particular has long lead times and often does not exist in usable form yet.
- Start the technical documentation file now; it is cheaper to maintain than to build.

What happens if the documentation isn't there
The packaging can be restricted
Packaging without valid technical documentation is treated as non-compliant. Market surveillance authorities can require corrective action, restrict sale, or withdraw it from the market.
Penalties apply per Member State
Each Member State sets its own penalties for non-compliance, and they apply where the packaging is placed on the market — not where your business sits.
Buyers block you first
Retailers, distributors and importers increasingly ask for the Declaration and supporting evidence before onboarding. No file usually means no listing.
Late evidence costs more
Supplier declarations and lab testing have long lead times. Discovering a gap close to a deadline forces rushed testing or packaging redesign.
